Contest Terms and Conditions
Below are the general terms and conditions for participating in the StreamJam Road to CMJ 2011 Contest (the "Contest") on StreamJam (the "Site"). By participating in the Contest, each participant agrees to be bound by the Contest Rules above and by this Agreement. All participants agree to the use of name, likeness, and entry material in any manner by Streamjam, CMJ, or any sponsors or partners, for advertising and promotion without further compensation, unless prohibited by law.
Eligibility: The Contest is open to legal residents of the 50 United States of America and the District of Columbia, who are 18 years of age as of August 19, 2011, and are fully able and competent to enter into the terms, conditions, representations, and warranties set forth in these Contest Rules. Employees of StreamJam, CMJ, advertisers, partners, sponsors, their immediate families and those living in same household are not eligible to participate in the Contest.
Entry: Any authorized user of StreamJam may enter the Contest by performing a live event in StreamJam during the contest period of August 19, 2011 to September 19, 2011 (the "Contest Duration"). These persons are referred to as "Entrants."
StreamJam performances that are eligible for the Contest must take the form of an original musical performance by the Entrant, making use of only intellectual property for which the Entrant has a legal right to use in an online live stream.
In addition, StreamJam reserves the right to disqualify for any reason, at our sole discretion, any Entrant whose content is found by StreamJam or CMJ to be inappropriate for the 2011 CMJ Music Marathon.
Scoring: Winners will be determined based on the total of unique visitors attending each the Entrant's events each day via StreamJam during the Contest Duration, as determined by StreamJam's event analytics. To be counted as a unique visitor for a day, a visitor must fully load the event space in StreamJam for one of that artist's events at least once in that day.
Please note that this is a total of unique visitors to the Entrant's events for each day. This means that a visitor returning twice to the Entrant's events in one day will be counted only once, but a visitor attending two separate events on separate days will be counted for both events.
On or about September 20, 2011, StreamJam will determine the winners of the Contest, and will contact the winners about their prize shortly thereafter.
In determining the winners, StreamJam may exclude any and all visitors that it determines, in its sole discretion, were counted fraudulently. This includes event visits by fraudulent accounts, the use of automated Internet 'bots' to create event visits, or any attempts at tampering with StreamJam.
If you are found to be participating in the creation of fraudulent visits, StreamJam reserves the right disqualify you and terminate your account.
Prize: Prizes are described in the Contest Rules. Note that StreamJam is not responsible for transportation to New York City, or room and board, for winners of the Grand Prize performance spot at CMJ.
If the Grand Prize winner is unable to travel to New York City to perform at CMJ 2011 Music Marathon, or has already received a slot in the CMJ 2011 Music Marathon, StreamJam reserves the right to award this performance spot to the next runner-up who is able to travel to New York City and has not yet been awarded a slot in the CMJ Music Marathon.
Winners: Visit CMJ.StreamJam.com after the specified Contest end date and time to find out the name of the Winners of the contest. Winners may be notified by email and must respond within three business days. If StreamJam does not receive a response within this time period, the winner may be disqualified and an alternate winner will be determined. Winners may make no substitution or transfer of prizes. All federal, state and local income taxes are the sole responsibility of winners. Winners assume all liability for any injury, damage caused or claimed to be caused by participation in this promotion or use or redemption of any prize.
Content: Any content submitted by Entrants for the Contest is subject to the StreamJam Artist Terms of Use, including without limitation all requirements set forth therein regarding intellectual property rights, licensing fees, and community standards for appropriate content. StreamJam reserves the right to disqualify any Entrant who violates the StreamJam Artist Terms of Use, remove the violating content, and terminate their account.
Termination of Services: StreamJam reserves the right to terminate any portion of the Site at any time, for any reason, with or without notice.
